Terms of Service

Before you run commands for the first time, Hana asks for your permission with a simple interactive button in Discord:

• No Logging Before Consent: If you haven't accepted these terms, Hana does not log your commands, activity, or diagnostics. Nothing is stored until you click Accept.
• Runs Right Away: When you click Accept, Hana remembers your choice and immediately runs your original command, no need to retype or run it again.
• Private Prompts: The agreement prompt is shown only to you as a private Discord message (ephemeral), keeping server channels clean.
• Decline Anytime: Clicking Decline closes the prompt, cancels your command, and clears all temporary data.

By using Hana Bot ("the Service"), inviting it to a server, or adding it to your personal Discord account, you agree to these Terms. If you add Hana to a server, you confirm you have permission from that server to do so.

• Server vs. Account Installs: Hana can be added to an entire server or to your individual account. If you run Hana commands in someone else's server from your account, you are responsible for following that server's local rules.
• Basic Health Diagnostics: To keep Hana running fast and fix bugs, we record basic health stats (like whether a command succeeded, error reports if something fails, and response times). We never read, save, or sell your private messages.
• Overall Community Counts: We track general bot numbers (like total servers and member counts) to manage server capacity, without ever identifying you personally.

We want Hana to be fun, helpful, and safe for everyone. When using Hana, you agree to standard community standards:

• Follow Discord Rules: You must follow Discord's official Terms of Service and Community Guidelines. Do not use Hana to post harmful, hateful, harassing, or illegal material.
• No Spam or Bot Automations: Using automated scripts, self-bots, or macros to spam commands, lag servers, or farm economy items is strictly forbidden.
• Rate Limits: Hana automatically limits how fast commands can be sent to stop spam attacks. Accounts that flood commands will be temporarily blocked to keep the bot fast for everyone else.
• Normal Chatting Is Welcome: Mentioning Hana or chatting casually with her is always welcome and is never flagged as an unauthorized command.
• Keep the Platform Safe: Trying to hack the bot, bypass safety filters, or attack our servers is strictly prohibited and results in an immediate, permanent global ban.

Hana connects to third-party artificial intelligence services (including Google Gemini, Groq, and Inception AI) to chat, synthesize responses, generate images, and perform AI-driven image editing:

• No Developer Control Over AI Outputs: AI models generate and edit content dynamically based entirely on user prompts, seed inputs, and reference images. The Developer does not pre-screen, manually review, select, alter, or endorse any AI-generated text, image, or media output. The Developer acts solely as a technical conduit and disclaims all liability for content produced by the AI.
• NSFW Image Generation & Editing Rules: Mature or adult content generation and AI image editing are strictly quarantined:
  • NSFW generation and editing functions operate only in designated Discord Age-Restricted (NSFW) channels and require the user to explicitly pass the --nsfw flag. Any attempt to invoke adult features outside age-restricted channels is strictly forbidden.
  • You must be at least eighteen (18) years of age (or the legal age of majority in your jurisdiction) to use any NSFW generation or editing tool.
• Absolute Ban on Non-Consensual Imagery (NCII) & Deepfakes: Generating, modifying, depicting, or editing explicit, intimate, sexualized, or defamatory images of real living individuals without their verifiable, express written consent is strictly prohibited. You may NOT upload photographs of any person to generate sexualized, nude, or non-consensual depictions. Any violation of this rule, or any creation or attempted creation of Child Sexual Abuse Material (CSAM/CSAE), will lead to an immediate global ban, blacklisting, and reporting to law enforcement and relevant reporting authorities without prior warning.
• User Sole and Absolute Liability: You assume sole civil and criminal responsibility for all prompts, reference images, source media, and instructions you submit, as well as any resulting outputs you download, display, or distribute. You warrant that you hold all necessary rights and legal permissions for any media you upload for AI editing. Under no circumstances will the Developer be held liable for third-party privacy violations, defamation, copyright infringement, or harm resulting from your use of AI generation or editing tools.
• AI Inaccuracies & Hallucinations: AI systems can produce inaccurate, unintended, offensive, or distorted responses despite upstream safety mechanisms. Use all AI outputs at your own discretion and risk.
• Usage Limits: To keep features fast and fair for everyone, daily quotas apply to AI generations and edits. Using alternate ("alt") accounts or automation to circumvent quotas is strictly prohibited.

Server administrators can customize Hana's avatar and banner inside their server using the /hana_profile command:

• Use Your Own Media: You are solely responsible for ensuring you have permission or copyright rights to use any picture, logo, or banner you upload.
• Audit Records: To comply with copyright laws (such as DMCA notices) and keep servers safe, Hana records the Discord User ID of the uploader, the server ID, a timestamp, and the image link.
• Rule Violations: Uploading illegal, trademark-infringing, or inappropriate images will result in Hana resetting the server style immediately and blocking the server from custom styles.

Hana provides server tools like auto-moderation, link filters, raid protection, and emergency anti-nuke defense:

• Emergency Defense (Panic Mode): Hana can detect rapid, unauthorized admin actions in your server. If an attack is detected, Hana can temporarily remove admin permissions from compromised roles to save your server.
• No Server Liability: Server owners use these moderation tools at their own risk. If a network delay or automated rule mistakenly bans a member or locks a channel, you agree to hold the Developer harmless.
• Member Ban Appeals: Server moderation decisions and ban appeals are handled entirely by your own server staff. Hana acts as a tool to help you moderate, not as a judge.

To keep communities safe and comply with platform rules, certain adult or sensitive features have clear safeguards:

• Age-Gated Features: Commands marked for adults or enabled via /rp allow-nsfw are strictly for users 18 and older. By enabling these settings, you confirm that you are at least 18 years old.
• No Real ID Required: We never ask for or store your real ID card, passport, or government documents. We only save a simple yes/no flag connected to your Discord ID.
• Both People Must Agree: For special interactive roleplay commands, the other user must click an accept button to agree. Trying to bypass or spam consent prompts is strictly forbidden.

Hana includes games, virtual items, and a pretend stock market for fun:

• Zero Real-World Cash Value: Hana's currency ("Chips") and virtual items are strictly for gameplay. They have zero real-world value and cannot be exchanged for cash, crypto, or gift cards.
• No Real-Money Trading: Buying or selling Chips, stocks, or virtual items for real money is strictly against our rules and Discord's policies. Anyone caught doing this will be permanently banned.
• Fair Play & No Farming: Using alternate accounts to repeatedly claim daily rewards or transfer virtual currency is cheating. Involved accounts will have their balances wiped and access revoked.
• Virtual Stocks: Player-created stocks are for entertainment only. If you do not keep your virtual stock active, its price may fall or reset; we do not restore lost virtual shares.

You can purchase optional digital enhancements either on our official web store (hanabot.xyz/shop) or directly inside the Discord desktop/mobile applications via Discord's In-App Purchases (SKUs):

• Digital License Only: Purchasing a Hana Plus pass or generation credit pack grants you a limited, revocable, personal, and non-transferable license to access the respective digital perks bound to your Discord User ID. You do not acquire ownership rights over Hana, its code, or infrastructure.
• Governing Law & Express Waiver of Withdrawal (EU / Italian Codice del Consumo): The Service is operated by an individual developer domiciled in Italy. In accordance with Article 59, paragraph 1, letter o) of the Italian Consumer Code (D.Lgs. 206/2005) and Article 16(m) of EU Directive 2011/83/EU regarding the supply of digital content not supplied on a tangible medium: by purchasing credits or passes, you provide your express consent to immediate digital execution and delivery, and expressly acknowledge that you lose your statutory 14-day right of withdrawal (diritto di recesso) once performance begins.
• Strict "Zero-Usage" Refund Policy:
  • Spent / Partial Usage (Strictly Non-Refundable): If you have consumed even a single credit (1 generation) or activated any portion of a pass, performance has actively commenced. In such events, no refunds (partial or total) will be issued under any circumstances.
  • Completely Untouched Packs: If a consumable credit pack is 100% completely unused and unspent, and was purchased via our website within the past fourteen (14) days, you may contact our support server to request a discretionary refund.
• Discord Native In-App Purchases: For transactions completed directly inside the Discord application using Discord's payment modal, Discord acts as the Merchant of Record. Those purchases are billed directly by Discord and are subject to Discord's Paid Services Terms. Any refund requests for transactions completed inside the Discord client must be directed through Discord's official billing support.
• Web Payments via Stripe: Transactions made on hanabot.xyz are processed through Stripe. We never store, process, or have access to your full payment card details or banking credentials.
• Prohibition of Chargebacks: Opening a fraudulent dispute or chargeback without first reaching out to our support team constitutes a material breach of these Terms. Any Discord account or server associated with an unauthorized chargeback will be permanently blacklisted and banned from Hana, with all accumulated credits and balances forfeited.
• Upstream Model Adaptations: Hana integrates third-party computational engines (including Google and Groq). We reserve the right to modify technical parameters, underlying models, or queue algorithms to preserve operational stability without altering the core functional delivery of your purchased credits.

We believe in keeping data simple, minimal, and fully under your control:

• Data Minimization: We only store what is required to make the bot work. We never sell your personal information or build advertising profiles.
• Right to Delete (GDPR): You can delete your data at any time using commands like /rp wipe and /timezone-remove, or by requesting a full account wipe on our support server.
• Server History: When Hana joins or leaves a server, basic server info (Server ID and name) is saved to track growth. Server owners can request this data to be cleared upon removal.
• Security Blocklist: Accounts confirmed to be maliciously attacking or exploiting the bot will have their Discord ID added to an internal safety blocklist to prevent further abuse.

We reserve the right to restrict or permanently ban any user or server from using Hana Bot if these Terms are violated, without prior notice.
